A Short, Heart-Felt Plea To Aubrey Chernick And John Jim Koshland...
It's clear you're a couple of rich guys who weren't blog savvy enough to know the blogosphere Turkey of the Century when it was put in front of you. That's too bad.
So before Batman and the Boy Wonder dig any further holes with your cash, have a lawyer review the implications of using "PJM" or "the PJM Network" interchangeably with "Pajamas Meda".
Here's why.
And please note, the Evil Minion who alerted me to this alerted them first.
...have a lawyer review the implications ...
Probably better to go to some lawyer other than Ed Driscoll's wife, as well. It's likely she oversaw the OSM fiasco.

Well, there's likely no dilution of their brand in their market, so I don't see why this will be an issue.

Isn't possible that if PJM decides to sue Pajamas Media, a lot of cash can be drained before a ruling is handed down?
Posted by: Nikki | November 22, 2005 at 03:01 PM
Tex,
A good dig. You're doing more reporting than Pajamas. I wonder if she was working on spec. All in the family, not a very wise business model. Unless you're the mafia I guess. But even they hire lawyers outside the family.

how is this the best of blogs?
Posted by: the illavator | November 22, 2005 at 03:47 PM
D, it's Jim Koshland rather than John. He's one of three named investors-another third is an investment partnership made up of other DLA Piper lawyers. Lawyers and more lawyers. No wonder there is so much drama.

My general sense is that PJM would not have a beef with Pajamas Media, unless Pajamas Media decided to go into a business involving the generation or transmission of electrical power.
C'mon, Mr. K, they're already mad as rats in a coffee can. Keep this up and I'll call the ASPCA!

Ha ha... pjm.com and pjm.org are already taken...

Dear Fellow Mercer School Graduate:
Heck, this is getting funnier than ever. Remember that Paddy Chayefsky movie, THE HOSPITAL, where one thing after another kept going wrong with a patient who came in for a minor procedure? That's what this reminds me of. Heck, I'm just a doctor and I KNOW YOU DO A SEARCH OF ALL THE TRADE AND COMPANY AND INTERNET NAMES BEFORE YOU DECIDE ON USING ONE. These guys are like from website and Hollywood backgrounds with some heavy-hiiter legal type bloggers they have on board and they didn't do this? Mierde.
Somewhere, Ann Althouse is smiling.

Hey Ken, I just had a perverse thought:
What if, after a decent interval, Aubrey Chernick And John Koshland stepped in to protect their assets, fired Roger, and hired a true professional with a track record of starting and managing successful publications.
Like ... Jeff Jarvis?

I thought this name-change announcement was better than the original one for the pic of Roger alone.
Posted by: Carpenter Ann | November 22, 2005 at 04:47 PM
Well, I thought you were talking some sense up to now, but now it's starts to look like you are doing this out of spite.
The 'pajama' people are in online media, and PJM Energy is an electrical grid operator. So two cannot easily be confused, so there is no trademark conflict there.
The classic example for this is the trademark lawsuit brought by Apple Records against Apple Computer. The result was Apple Computer was on pretty safe legal ground... as long as they didn't get involved in music distribution.
Posted by: Electrolux | November 22, 2005 at 04:55 PM
And, of course, we all know that Apple Computer stayed out of music distribution.
=))
Posted by: Scott Ferguson | November 22, 2005 at 04:57 PM
Hum... I knew it was Jim Koshland, not John Koshland. I did.
I was testing to see if you were paying attention...
Besides, the guys in the suits made me call him John...
And Jim gave us permission...
And...

Didn't fifty mil change hands between Apple computer, and Apple records recently?
The original agreement waaaaay back when was "no music."

They'll probably get away with "PJM", but maybe not "PJM Network".
And just what, exactly, is wrong with spite? It seems that a little spite may be in order. So long as it's fun, anyway. When it stops being fun, then to hell with it.
(Someone needs to tell Charles that the osm.org website is a cluster-f***. You'd think he might have noticed -- just try finding a post from one minute to the next -- but it's not getting any better.)

A little clarification. I'm not a lawyer, so maybe they will get away with using the PJM since there businesses are so different. However, those in the electricity industry often refer to the rto as the PJM network since they run, you know, the electricity network. In addition, PJM is generally considered the leader in building online electricity markets, so they do have some interest in protecting their name in online forums.

Carpenter Ann,
I linked over to your satire. Didn't get past the second sentence. Roger is a piece of work and whole lot of other unsavory things, but he isn't anti-muslim. Get a clue.
Posted by: Bolyn | November 22, 2005 at 05:46 PM
Roger says the site has already had over five million page views. Heck I've given him a thousand. Will I buy anything advertised? No. I only go there for reconnaisance.
Posted by: James | November 22, 2005 at 05:50 PM
I love that irony of Chaz insulting Ann Althouse simply because she wasn't willing to be a good little girl and sing his praises, allowing the most filthy sexist remarks about her to be published under his byline while pretending to be above that sort of thing himself.
Audrey and Jim K. and DLA Piper Partnership had better notice things like that too, because some of the people they're funding seem happy to use their positions to extract vengeance against perceived enemies.
Bad combo.

The current entry on the homepage at OSM:
Returning from reconnaisance
The current entry on OSM's front page:
"Frying turkeys is a big deal here in Louisiana, where we are apt to fry anything that walks, flies, swims or crawls. Out in my shed, I have my turkey frying gear set up, ready to go…. Turkey frying is best done outdoors, because you are going to make a damned mess. I guarantee it. Any fool who fries a turkey indoors runs a very real risk of burning down the house. Be forewarned. No need for comment.

Indeed. Johnson is the one who is famous for this, not Simon. Heh.

Scott Ferguson -- That's the usual course with most VC start-ups. Once -- if -- the venture shows legs, the investors dump the innovators (using a term loosely here) and bring in managers to harvest the proceeds. The fact is, even assuming PJM stays up, the bloggers who signed up to work for Roger and Charles won't be working for Roger and Charles.

So, how does one go about signing up to be an Evil Minion?
